But it’s almost unheard of that someone who files a frivolous lawsuit can be held accountable, as they can be in most countries. The reason so many civil cases are settled are even if you are right, did nothing wrong - it costs so much to defend yourself that most settle. The fact you can’t file against a frivolous suit is a feature of our legal system. It keeps attorneys in business. In most countries you must pay fees and penalties if you file a civil case and lose. Even in the states if you win a civil case against someone who brought the case against you you can’t sue them for damages or legal fees. I prefer the English system. There are downsides. Murdoch has effectively silenced UK critics by misusing the mechanisms intended to inhibit frivolous/vexatious cases. In the event a court agrees with the complainant, but orders a sum to be paid that is even a penny under the settlement sum already offered, the complainant is liable for all legal fees of both sides. Due to the defendant being able, effectively, to make a number up regarding their costs, this allows defendants with financial resources to stop complainants of limited means airing the issue in court.

Westinghouse was forced to sell them Unfortunately in the states the legal lobby is so big that most of these legal problems are features and not bugs. When Obama passed got Obamacare passed a feature was the legal profession would not be touched (tort is the largest contribution to high health costs and the trial lawyers assn made sure via donations their industry would not be touched). When he bailed out the auto industry a condition of the bailouts were no more contracts would be allowed for any supplier or auto related deal that allowed for arbitration. Now they all require going thru attorneys and the court process. Follow the money.
